1. Définitions

In the context of the General Terms and Conditions of Sale, the following terms used with a capital letter, in the singular and/or plural, mean :

  • “Users”: refers to any person visiting the site.
  • “Client/Learner”: refers to any User who has signed a Data Science training contract with DataScientest.
  • “Attestation of Completion”: an attestation issued to the learner when he or she successfully completes the course and obtains a sufficient score to obtain the Attestation;
    The Attestation of Completion covers all of the skills acquired during the data science training program.
  • “Courses”: Courses in the form of text, image, video, created by any expert in a field; Courses may include exercises in the form of quizzes, evaluations and project defenses evaluated by Cohort Leaders.
  • “Cohort Manager”: Experienced Data Science expert in charge of monitoring the learner individually or in a group; the Cohort Manager defines the learner’s learning and progress objectives and schedule, provides pedagogical support for the success of the Projects, monitors the learner’s data science training and validates his/her skills during oral evaluation sessions.
  • “Course”: training in a profession or an activity, composed of Projects and Courses, with the personalized pedagogical support of a Cohort Manager, proposed to the Learner.
  • “Project”: Practical exercises proposed to the learner as part of a course.
  • “Service”: access to online educational services on the DataScientest Platform

2. General provisions relating to the General Terms and Conditions of Sale

These General Terms and Conditions of Sale define your rights and obligations as a Client/Apprentice in the context of a contractualized data science training course and apply throughout the duration of the Services being put online on the Platform.
The General Terms and Conditions of Sales are enforceable against the Learner who acknowledges, by ticking the box provided for this purpose, that he has been made aware of them and has accepted them before beginning his training course.
The General Terms and Conditions of Sale were communicated prior to the order, and are also accessible at any time on our Site and at the time of the order. They are issued by the company DataScientest, whose contact details appear in art.1 “Legal Notice” of the Terms and Conditions of Use, which must also be accepted.

3. Service Description

3.1 Tariffs and choice of route

The price of each Service is indicated inclusive of all taxes and expressed in Euros.
You have the possibility to subscribe to one of our certified data science courses available in French and English.

3.3. Training fees

The mandatory Registration Fee is five hundred (500) Euros and will be requested at Registration to reserve your place.
No additional costs to the original Service price subscribed to by the Client/Learner will be charged without the express consent of the Client/Learner.
Finally, we reserve the right to refuse any registration if you are a minor.

3.4. Modification of your Course

If you wish to modify the Course you have just subscribed to, you can contact our team by email
The modification of your Course will be subject to the agreement of DataScientest’s pedagogical team.
Any modification of the Course is equivalent to a new contract and is therefore subject to the same formalities as the initial contract.

3.5. Purpose of the order

The Data Science Learning Path, which is the subject of the order, will be made available to the Customer/Learner in the E Learning platform.
All of the following pedagogical information is accessible on the platform, in French and in English: the content of the program, the provisional schedule of work (Evaluations, Projects, group exercises), the schedule of sessions with the Cohort Manager, the average duration in number of hours and the Data Science professions accessible following the Course.
DataScientest grants the Client/Learner a non-exclusive and non-transferable user license consisting of the opening of an access with an identifier and a password to the Platform which will be given to him on the first day of training.
This access allows the User to :

To access the Platform and all the Services throughout the duration of his training, and this, from the acknowledgement of receipt of the access confirmation e-mail sent by DataScientest, after which the access will be deactivated;
To benefit from personalized pedagogical support from a data science expert, the Cohort Manager, who ensures regular monitoring of the learner’s data science skills development.
To benefit from access to courses and practical exercises on the Platform.
To have access to discussion areas with other Users in accordance with the General Terms of Use and the Rules and Guidelines of Good Conduct.
Upon successful completion of a course, a Certificate of Completion attesting to the knowledge and skills acquired by the Customer/Learner is issued.

3.6. Withdrawal period

Within the framework of the application of articles L.221-18 to 28 of the Consumer Code, the Customer, when he is legally a “consumer”, has a period of 14 days to exercise his right of retraction.
The right of withdrawal may be exercised by contacting the company in writing. The right of retraction cannot be applied in the cases referred to in Article L.221-28 of the French Commercial Code. Moreover, the Customer expressly waives his right of withdrawal by signing the Contract and/or an order form concerning a training course whose execution begins before the end of the withdrawal period.

4. Learner Obligations

By subscribing to a Data Science training course at DataScientesthe Customer/Learner commits to respecting the commitments referred to in the Learner Rules, including the rules relating to the attendance of follow-up sessions . We inform you that failure to comply with the rules of the Learning Regulations may lead to sanctions imposed by the DataScientest Disciplinary Board.

The edition of the site is ensured by the Company Datascientest with a capital of 1 000 €, registered 011755665975 with the RCS of Paris under the number 831 450 069 whose registered office is located at 16 boulevard Flandrin 75016 Paris,

4.1. Cancellation

In accordance with the provisions of article L221-28 1° and 13° of the Consumer Code, no cancellation will be possible from the moment the Client/Learner has used his access codes to access the training platform, which will be deemed to be the beginning of performance and renunciation to exercise his right of retraction.
Any cancellation or postponement of registration on the part of the Customer must be reported and confirmed in writing. Cancellation occurring more than fourteen (14) calendar days before the start of the course shall not give rise to any invoicing.
Cancellation between fourteen (14) and seven (7) calendar days prior to the start of the course will result in an invoice equal to 20% of the course fee. Cancellation less than seven (7) calendar days before the beginning of the course will be invoiced for the full amount of the course.
The contract may be terminated by the Client/Learner or his legal representative if, due to force majeure, he is prevented from attending the corresponding course.

4.2 Methods of payment

DataScientest offers you two (2) payment methods to pay the Training Fees, the Registration Fees must be paid in one installment (art. 3.2). Once these fees have been paid, the learner has the possibility to

1st modality: cash payment of the totality of the training fees.

2nd modality: payment in several monthly installments.

When confirming your order, our partner Pledg will offer you to choose the Payment service in 3, 6 or 10 installments to settle your order. If you wish to subscribe to this service, your contact information will then be transmitted to Pledg who, subject to acceptance of your file, will offer you to pay in 3, 6 or 10 installments and will provide you with a payment schedule summarizing the amount of the different monthly installments. 

Depending on your file, supporting documents may be requested to validate your financing request. For payment in installments: as soon as Pledg accepts your application, you will have to pay the amount of the 1st monthly installment including a fee of 1.5% / 3.55% / 6.45% (depending on whether you have opted for payment in 3 / 6 / 10 installments respectively) of the total amount of the order.

You will be debited for the remaining monthly installments according to the payment schedule that will have been communicated to you. 

How it works Payment in 3 installments: Payment in 3 installments allows you to pay for the order placed on DataScientest in the following way: A mandatory contribution, debited on the day of the order confirmation, corresponding to part of the order and a fee of 1.5% of the total amount of the order, if the fee is not offered. 

Operation Payment in 6 times: The payment in 6 times allows you to pay the order made on DataScientest in the following way: A compulsory contribution, debited on the day of the order confirmation, corresponding to a part of the order and a fee of 3.55% of the total amount of the order, if the fees are not offered. 

Operation Payment in 10 times: The payment in 10 times allows you to pay the order made on DataScientest in the following way: A mandatory contribution, debited on the day of the order confirmation, corresponding to a part of the order and a fee of 6.45% of the total amount of the order, if the fees are not offered. 

A distribution of the remaining amount of the order over the number of remaining monthly installments according to the payment schedule that will have been communicated.

4.3. Paiement

Payment is made by the following means:

  • By credit card through the secure payment interface on the DataScientest platform
    We use an online payment security system that encrypts the transmission of the parties’ bank details.
  • The payment module used is the “Stripe” system, a secure and certified platform. Please note that the learner will be automatically debited on the dates mentioned.
  • The Customer must then fill in his personal and bank details and accept the General Terms and Conditions of Sale by ticking the box provided for this purpose.
  • By check with payment made out to DataScientest.

4.4. Default of payment

In the absence of payment of the price on the due date, we reserve the right to demand payment, to suspend the execution of the Services concerned or to terminate the contract between us by operation of law. Any sum not paid on the due date shall bear interest at the legal rate, without prior notice of default.

Any sum due by the Customer/Learner, not paid on time, will be increased by right and without prior formal notice, with interest of 5% per month from the due date.
In any event, any Customer/Learner in a situation of late payment will automatically owe DataScientest a minimum fixed compensation of forty euros for collection costs (Article D.441-5 of the Commercial Code).
In addition, DataScientest reserves the right, fifteen days after sending a formal notice to pay by registered letter, partially or totally ineffective, to suspend the Service until full payment of the amounts due and if this payment is not made, to automatically terminate the contract with immediate effect.

4.5. Facturation

An invoice is established for each order placed.
Invoices for your orders will only be sent electronically. In the near future, electronic invoices will be made available to you in .pdf format in your personal space on our Platform.

5. Platform availability and modification

The Services broadcast on the Internet are normally accessible 24 hours a day, 7 days a week, except in cases of force majeure, events beyond the control of DataScientest and/or the Service host, possible breakdowns or maintenance interventions related to the technological evolution of the Platform or necessary to ensure the proper functioning of the Service. DataScientest reserves the possibility of carrying out interventions on the resources made available to the Learners in order to carry out corrective, curative or evolutionary maintenance of the site. Any remote maintenance is preceded by an information to the Customer by e-mail 24 hours before the maintenance is carried out. This maintenance will be carried out at night at a rate of one hour once a week.
We undertake to make every effort to guarantee the accessibility and continuity of the Platform’s Services, but we are only bound by an obligation of means concerning the continuity of access to the Service.

6. Responsibility

The Customer/Learner is solely responsible for the choice of Services provided by DataScientest, their conservation and use.
The Customer/Learner declares that he is aware of and accepts the characteristics and limits of the transmission of information via the Internet network, as well as the expenses related to the connection, he acknowledges that it is his responsibility to ensure that the technical characteristics of the equipment he uses allow him access to the service under the best conditions, in particular with regard to the transmission of documents via the Internet, and to take all appropriate measures to be protected from contamination by any harmful programs.
DataScientest’s liability can only be engaged in case of proven fault or negligence and will be limited to the direct prejudice suffered by the Client/Learner, excluding any indirect prejudice. In the event that DataScientest is held liable, the total amount of any sum charged to DataScientest may not exceed the total amount of the price paid by the Client/Learner for the Service concerned.

6.1. Intellectual Property

The contents of the Courses and the Courses are the property of DataScientest and its partners. The brands, logos, signs as well as all the contents of the site (texts, images, sound…) are protected by the Intellectual Property Code and more particularly by copyright. The User must request prior authorization from the site for any reproduction, publication, copy of the various contents. He or she undertakes to use the contents of the site in a strictly private context. Any use for commercial and advertising purposes is strictly forbidden. Any total or partial representation of this site by any process whatsoever, without the express permission of the operator of the website would constitute an infringement punishable by Article L 335-2 and following of the Intellectual Property Code. It is recalled in accordance with Article L122-5 of the Code of property

7. Applicable law - Mediation

The General Conditions of Sales are subject to French law.
In the event of a dispute and prior to taking the matter to court, the Client/Learner has the right to resort to mediation in order to reach an amicable solution.

In the event that a contractual clause is null and void, this shall not entail the nullity of the General Terms and Conditions of Sale. On the other hand, the temporary or permanent inapplicability of one or more clauses of the General Terms and Conditions of Sale by DataScientest does not constitute a renunciation on its part of the other clauses of the General Terms and Conditions of Sale which continue to produce their effects.
